Terms of Service

1. What HermesRecall provides

HermesRecall is a managed hosting service for a persistent-memory AI agent. We operate the infrastructure; you operate your agent by sending it messages through Telegram, WhatsApp (Max plan), or the dashboard chat.

2. Bring your own AI key

You provide your own API key from a model provider (Claude, OpenAI, Gemini, or any supported provider). You pay that provider directly for token usage. We never charge a markup on your AI usage and never have access to your raw key beyond what's needed to route requests.

3. Subscription & billing

Plans are monthly or annual, billed in advance through Stripe. You can cancel at any time from the Plan & Billing tab. Cancellation takes effect at the end of the current billing period. No refunds for partial periods, but you keep access until the end date.

Prices are listed in EUR on /fr and USD on the English site. Taxes (VAT where applicable) are added at checkout based on your billing country.

4. Acceptable use

You are responsible for the content you send through your agent. Do not use HermesRecall to: generate illegal content (CSAM, credible threats, fraud), send spam or harassment, reverse-engineer our infrastructure, or circumvent rate limits. We reserve the right to suspend accounts that violate these rules.

5. Availability

We target 99.5% monthly uptime. If we fall below that threshold in a given month, you get a pro-rated credit on your next invoice (request it at support@hermesrecall.com). Scheduled maintenance, force majeure, and third-party provider outages (Telegram, WhatsApp, your AI provider) are excluded.

6. Your data

You own your data. See the Privacy Policy for how we handle it. If you cancel, you have 30 days to export your memory (from Advanced → Export) before we delete it.

7. Changes to the service

We'll add features as the product grows. We won't silently remove features you pay for: if a material capability is removed, we'll notify active subscribers 30 days in advance and offer a pro-rated refund if you want to leave.

8. Liability

HermesRecall is provided on an 'as is' basis. To the extent permitted by law, our total liability for any claim related to the service is capped at the amount you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or incidental damages.

9. Governing law

These terms are governed by French law. Any dispute that cannot be resolved amicably will be handled by the competent courts in Paris, France. If you are a consumer in another EU country, you retain the protection of your local consumer law.
